Occupational injury and occupational illness
If you have suffered harm at work you are entitled to compensation from your employer’s occupational injury insurance provider.
Examples of industrial harm are personal injury, illness or death as a result of a work-related accident. Typical work-related injuries are fractures or broken bones as a result of falls; cuts from use of tools; and harm resulting from assault or violence against workers from service users, patients or pupils, as well as crush injuries.
If it is the result of harmful effects from your working environment and is among the illnesses listed in the occupational disease regulations, illness may also be recognised as an occupational disease. Typical occupational diseases are asthma, hand dermatitis, COPD (chronic obstructive airways disease) and lung cancer.
Injury caused by road traffic accidents
If you are the victim of a traffic accident you may be entitled to damages from your insurance company, or from the insurance provider of the person who caused the accident.
Medical malpractice or negligence
Any personal harm suffered during treatment in a medical institution, during ambulance transport, or as a result of other medical treatment by health personnel is a case of malpractice.
If you have suffered medical harm, you are entitled to compensation for damages from the Norwegian System of Compensation to Patients, providing the harm is a result of one of the following:
1. Deficiency in the provision of health care, even if no single person is to blame.
2. Technical faults in devices, instruments or other equipment used in the provision of medical care.
3. Contagion or infection, if this is not primarily a consequence of the patient’s condition or illness.
4. Vaccination.
5. Circumstances entailing liability for the health and care services or health personnel according to the general rules governing compensation.
In addition, compensation may be awarded in special cases if you suffer very substantial harm that was not foreseeable, and which was not an outcome of the acceptable risk to a patient, even if the harm you suffer does not fall under one of the instances summarised in the above points 1–5.
Other types of bodily harm
Accidents occur when you least expect them, in many cases out of sheer mishap. In other cases the accident is caused directly by a person who is at fault.
Settlement of your financial loss will depend on the circumstances surrounding the accident. Harm suffered in your leisure time falls under a variety of insurance schemes; if the incident was a result of violence or other abusive conduct you may be entitled to compensation from the Criminal Injuries Compensation Authority.
